Advertising Policy

BlackHealthOnline (BHO) requires advertisers to provide ads that are accurate, in good taste, and otherwise comply with our Advertising Policy.

The following guidelines have been established by Black Health Online, Inc. to govern various aspects of Advertising on the BHO Network, which includes websites and mobile applications directed to consumers, which we refer to as the "BlackHealthOnline Consumer Properties," and websites and mobile applications directed to healthcare professionals, which we refer to as the "BlackHealthOnline Professional Properties." As used in this policy, the terms "Advertising" and "Advertisements" include third party banners, badges, contextual advertising, and sponsored content. The guidelines in this policy govern issues like acceptance of Advertisements by BHO, how Advertisements are displayed on the BHO Network, and the removal of Advertisements from the BHO Network. BHO has sole and absolute discretion with respect to interpretation and enforcement of this policy and all other issues associated with Advertising on the BHO Network. BHO may change this policy at any time in its sole discretion by posting a revised policy to the applicable BHO Property.

1. BHO has sole discretion for determining the types of Advertising that will be accepted and displayed on the BHO Network, and under no circumstances will BlackHealthOnline's acceptance of any advertisement be considered an endorsement of the product(s) and/or service(s) advertised or for the company that advertises, manufactures, distributes, or promotes the products or services.

2. BHO will not accept Advertising that, in BlackHealthOnline's opinion, is not factually accurate and in good taste.

3. There are certain categories of advertisements that BHO will not permit on the BHO Network at any time. These categories include but are not limited to the following:

Illegal, 'objectionable', 'ineffective' and/or 'dangerous' products (BlackHealthOnline reserves the right to determine what is 'objectionable', 'ineffective' and/or 'dangerous')
Fraudulent, deceptive, illicit, misleading or offensive material
Material that misrepresents, ridicules, discriminates (real or implied) or attacks an individual or group on the basis of age, national origin, race, religion, gender, sexual orientation, marital status, disability or any other status deemed inappropriate for the BHO Network
Alcohol
Weapons, firearms, ammunition, or fireworks
Gambling
Pornography or related themes
Tobacco use of any kind
The simulation of news or an emergency
Material that directly advertises products to or is intended to attract children under the age of 13
Media or messages for or that reference "M" rated video games or content
Unreasonable, unlikely or extraordinary product or service claims
Media messages or imagery that strobe or flash
Media or messages that contain unsubstantiated "miracle" weight loss or other miracle claims of cure
Advertising units that extend beyond the defined advertising space or interfere with the content or impact the readability of the content without user initiation
Advertising units that do not retract to the defined advertising space upon user scroll off or do not contain a "close" or "X" for user to retract or close the ad unit/message after user initiation
Advertising units that mimic computer functions or deceptively indicate a computer or other function that would be reasonable to the average user to assume as a reason to click the unit

4. BHO recognizes and maintains a distinct separation between advertising and sponsored content and editorial content. All Advertising or sponsored content on the BHO Network will be clearly and unambiguously identified. BHO will not allow any Advertising on a BHO Consumer Property that is not identified with the label of "Advertisement", "From Our Sponsor" or a similar designation, or on a BHO Professional Property that is not identified with the label of "Advertisement," "Information from Industry," "From Our Sponsor" or some similar designation indicating that the content is being provided by or on behalf of the sponsor.

5. A click on an Advertisement may only link the end user to the third-party advertiser's site or to relevant sponsored content area on a BHO Property.

6. BHO retains the exclusive right to determine how any and all search results for specific information by keyword or topic are displayed on applicable BHO Properties based on BHO delivered search results. Content listed in search results is displayed with its source, e.g., "BlackHealthOnline News" or "Journal Article." If sponsored content appears in the search results, it is labeled as "BlackHealthOnline Sponsor" on the applicable BHO Consumer Properties and "Industry Information" on the applicable BHO Professional Properties so that users can make informed decisions about the content they wish to view. In addition, BHO provides a separate area on the search results page of applicable BHO Consumer Properties labeled "BlackHealthOnline Sponsors" or "Featured Sponsor on BlackHealthOnline" in which sponsors and advertisers may purchase space to list their content or advertising.

7. As described in the "Ads by Google" hyper link in the Ads by Google section on applicable BHO Consumer Properties Search pages, these "Ads by Google" are listings that have been purchased by companies that want to have links to their websites appear adjacent to search results in response to specific terms. BHO may receive payment from Google in connection with displaying the sponsored link results on these BHO Consumer Properties or based on clicks on these links.

8. While third party (sponsor or advertiser produced) content must adhere to this Advertising Policy, labeling of sponsored content on the BHO Consumer Properties is governed by Our Sponsor Policy, which describes how we label information from our Sponsors and the steps we take to help our end users understand the differences between BHO content and sponsored content.

9. Advertising on the BHO Professional Properties may not link directly to a registration/email capture page. Any user registration or email capture pages resulting from an ad click on a BHO Professional Properties must be, at minimum, two clicks away from the original Advertisement. The BHO Professional Properties will not run Advertising that requires registration and/or log-in in order to view a significant portion of the content of the Advertising or the related site. BHO reserves the right to determine what level is 'significant'.

10. BHO reserves the right to approve whether it will accept, reject, cancel, or remove at any time any Advertising from the BHO Network for any reason and will provide prompt notice to the advertiser upon rejection, cancellation, or removal of any Advertising, together with an explanation following the rejection, cancellation, or removal. BHO cannot provide any assurances that client programs or components will perform without error on all platforms, including websites, mobile devices and Apps.

11. It is the Advertiser's responsibility to comply with all domestic and foreign laws and regulations applicable to its Advertising within the BHO Network (and to include all legally required legends, disclosures and statements in such Advertising), including without limitation the current FDA guidelines for Direct to Physician (DTP) and Direct to Consumer (DTC) advertising. BHO will not monitor compliance with such laws and regulations. However, BHO reserves the right to review all Advertising for compliance with applicable laws and regulations and, if BHO becomes aware of any breach or potential breach of any applicable law or regulation or of these guidelines, BHO may remove the Advertising from the BHO Network.

12. No Advertising on the BHO Network shall include any pixels, tags, flash containers or any other type of information collection software code or shall place any beacons, cookies or other information collection devices on the browsers of users of the BHO Network unless expressly approved in writing by BHO. No personally-identifiable information may be collected from any user of the BHO Network without the express written consent of BHO and the express opt-in consent of such user. No non-personally-identifiable information that is collected from a user of the BHO Network may be linked to any personally-identifiable information available to an advertiser without the express written consent of BHO.

Registration

Access to some BHO interactive tools and services may be limited to users who have registered. BlackHealthOnline mobile App stores your Personal Information in accordance with this Privacy Policy. You may also be asked to provide authorization for uses of personal information in addition to what is in this Privacy Policy when you use certain tools, such as providing personal information to a sponsor of the tool. BHO will not make any use of your personal information beyond the permitted uses in this Privacy Policy unless you provide such additional consent in connection with the specific tool at the time you submit Personal Information in order to use the tool. Refund Policy

BHO Membership fees and services payments are NON-REFUNDABLE. ‘What if I am not satisfied with my response?’

Your chances of getting a useful and satisfactory response increase if you complete or update your Health Profile and ask clear and precise questions. Include as much detail as possible. You should clearly describe the symptoms, attach any doctor’s reports and relevant laboratory and radiological results. User Submissions

The personal information you submit to BHO is governed by the BlackHealthOnline Privacy Policy. To the extent there is an inconsistency between this Agreement and the BlackHealthOnline Privacy Policy, this Agreement shall govern.

The site contains functionality (including blogs, testimonials, etc.) that allows users to upload content to the site (collectively "Public Areas"). You agree that you will not upload or transmit any communications or content of any type to the Public Areas that infringe or violate any rights of any party. If you make any submission to a Public Area or if you submit any business information, idea, concept or invention to BHO by email, you automatically grant-or warrant that the owner of such content or intellectual property has expressly granted-BlackHealthOnline a royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and display the communication or content in any media or medium, or any form, format, or forum now known or hereafter developed. BHO may sublicense its rights through multiple tiers of sublicenses. If you wish to keep any business information, ideas, concepts or inventions private or proprietary, do not submit them to the Public Areas or to BHO by email. We try to answer every email in a timely manner, but are not always able to do so.

You agree to only post or upload Media (like photos, videos or audio) that you have taken yourself or that you have all rights to transmit and license and which do not violate trademark, copyright, privacy or any other rights of any other person. Photos or videos of celebrities and cartoon or comic images are usually copyrighted by the owner.

To protect your privacy, you agree that you will not submit any media that contains Personally Identifiable Information (like name, phone number, email address or web site URL) of you or of anyone else. Uploading media like images or video of other people without their permission is strictly prohibited.

By uploading any media on the BlackHealthOnline site, you warrant that you have permission from all persons appearing in your media for you to make this contribution and grant rights described herein. Never post a picture or video of or with someone else unless you have their explicit permission.

Passwords

BlackHealthOnline Community and Member to Member Areas ("Public Areas")

If you use a Public Area, such as message boards, testimonials, blogs, Ask Our Expert, User Reviews or other member communities, you are solely responsible for your own communications, the consequences of posting those communications, and your reliance on any communications found in the Public Areas. BHO and its licensors are not responsible for the consequences of any communications in the Public Areas. 3. Posting material that is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity as determined by BlackHealthOnline in its sole discretion;

4. Posting advertisements or solicitations of business;

5. After receiving a warning, continuing to disrupt the normal flow of dialogue, or posting comments that are not related to the topic being discussed (unless it is clear the discussion is free-form);

6. Posting chain letters or pyramid schemes;

7. Impersonating another person

8. Distributing viruses or other harmful computer code;

9. Harvesting, scraping or otherwise collecting information about others, including email addresses, without their identification for posting or viewing comments;

10. Allowing any other person or entity to use your identification for posting or viewing comments

11. Posting the same note more than once or "spamming"; or

12. Engaging in any other conduct that restricts or inhibits any other person from using or enjoying the Public Area or the Site, or which, in the judgment of BlackHealthOnline, exposes BlackHealthOnline or any of its customers or suppliers to any liability or detriment of any type.

BlackHealthOnline Reserves the Right (but is Not Obligated) to do any or all of the Following:

1. Record the dialogue in public chat rooms.

2. Investigate an allegation that a communication(s) do(es) not conform to the terms of this section and determine in its sole discretion to remove or request the removal of the communication(s).

3. Remove communications which are abusive, illegal, or disruptive, or that otherwise fail to conform to these Terms and Conditions.

4. Terminate a user's access to any or all Public Areas and/or the BlackHealthOnline Site upon any breach of these Terms and Conditions.

5. Monitor, edit, or disclose any communication in the Public Areas.

6. Edit or delete any communication(s) posted on the BlackHealthOnline Site, regardless of whether such communication(s) violate these standards.

BlackHealthOnline or its licensors have no liability or responsibility to users of the BlackHealthOnline Site or any other person or entity for performance or nonperformance of the aforementioned activities.
